Wyndham Wrocław Old Town Hotel (“Hotel”, “We”, “Controller”) attaches great importance to protecting your privacy and securing your personal data. The privacy policy describes how, why, and for how long we will process your personal data. The privacy policy also sets out your rights in relation to the processing of your personal data. Please read it carefully.

The Hotel processes personal data of Guests, contractors, and other persons who are interested in the Hotel’s services or cooperate with the Hotel. The processing of personal data is always carried out for legitimate purposes, respecting the rights and freedoms of the data subjects.

Who is the personal data controller?

The personal data controller is Presic Sp. z o.o., having its registered office in Wroclaw, sw. Mikołaja str 67, KRS 0000896939, who is the Hotel operator. The controller has appointed a Data Protection Officer who can be contacted at dpo@mogotel.com

To the extent that the personal data of the Hotel Guests are used for the purposes of the Wyndham Rewards loyalty program operated by Wyndham Hotel Group, LLC (“Wyndham”), as well as when booking hotel services directly through www.wyndham.com, the controller of the data is Wyndham Hotels&Resorts. We encourage you to read Wyndham’s privacy policy available at wyndham.com in the Privacy Notice tab.

Why and on what legal basis do we process personal data?

We process personal data for a variety of purposes:

Personal data of the Hotel Guests

The scope of personal data of the Hotel Guests that we process includes:

Name and surname,
Contact details: email address, telephone number,
Identity document number,
Address of residence,
Date of stay,
Preferences regarding the Hotel services and the scope Hotel services used,
Payment data and data for VAT invoices.

We process personal data of Guests for the purpose of providing hotel and associated services. We process personal data not only of persons who have directly entered with us into a contract for the provision of hotel services, but also of persons who accompany our Guests or are beneficiaries of Hotel services (e.g. guests of an event or party held at the Hotel). We also process guests’ personal data to improve the quality of our services, to anticipate future demand for our services, and to meet the Wyndham network standards.

We also process our Guests’ personal data for tax purposes (e.g. in connection with issuing VAT invoices) and other legal purposes (e.g. the Accounting Act).

Personal data of Guests are also processed by us within the scope of video surveillance. The purpose of the surveillance is to ensure the safety of the Hotel’s guests and other persons staying on the premises. It also protects the property on the premises of the Hotel.

The basis for processing the Guests’ personal data is primarily the contract for the provision of hotel or associated services (Article 6(1)(b) of RODO). We also process personal data on the basis of Article 6(1)(c) of the GDPR, i.e. to the extent necessary to fulfil legal obligations imposed on the Hotel and on the basis of our legitimate interests, which finds its legal basis in Article 6(1)(f) of the GDPR.

Personal data of persons interested in the services of the Hotel

We process personal data of people who are interested in our services - e.g. they contact us by phone or fill in the contact form on our website. The purpose of processing personal data is to be able to establish contact with persons interested in our services, and the basis for processing personal data is Article 6(1)(f) of the GDPR.

Personal data of persons entering into contracts with the Hotel

When entering into a cooperation agreement with the Hotel or any other agreement to which the Administrator is a party, the Hotel processes the personal data of persons representing our counterparty in order to perform the agreement. The legal basis for data processing is Article 6(1)(f) of the GDPR.

Personal data of persons who have lodged a complaint or a grievance, or of persons with whom we are in a legal dispute

If a complaint or a grievance is lodged in relation to our services, we will process personal data for the purposes of investigation. In the case of persons with whom the Controller is in a legal dispute, we will process personal data for the purpose of asserting and defending claims. The legal basis for processing personal data is Article 6(1)(f) of the GDPR.

Personal data of persons who have consented to marketing communications

The Hotel processes personal data of persons who have consented to receive marketing communications from the Hotel. The legal basis for processing personal data is consent (Art. 6(1)(a) of the GDPR), which can be withdrawn at any time.

What are the consequences of not providing data?

If you refuse to provide personal data, the provision of hotel services, the conclusion of a contract or the establishment of contact by the Hotel will not be possible.

Who may be the recipient of personal data?

For the purposes of conducting our business, we may entrust personal data to our subcontractors or share data with our partners.

We cooperate with independent controller Joint stock company (AS) Mogotel Hotel Group Having its registered office in Latvia (address: Latgales str. 240–3, Riga, LV-1063, Latvia) – “Mogotel”, and processor Mogotel development holding LLC Having its registered office in Latvia (address: address: Latgales str. 240–3, Riga, LV-1063, Latvia) – “MDH”, which is our majority shareholder and operates in the hotel industry supporting us in many areas. Mogotel and MDH provides us with business support services.

Our subcontractors and partners may in particular receive personal data if they provide the following services to us:

accounting and auditing services,
banking and insurance services,
security services,
taxi or transport services,
IT and programming services,
legal services.

Recipients of data may also be state entities (e.g. police or courts) if they request such data.

The Hotel will process your personal data for the following period:

Hotel Regulations
Hotel Regulations

These Regulations set out the rules of service provisions, liability and stay on the premises of Wyndham Wroclaw Old Town (hereinafter referred to as the "Hotel") and are an integral part of the contract that is concluded by making a reservation, paying a deposit or the entire amount due for the stay, or by signing the registration sheet.

§1
1. Hotel rooms are rented by the day.
2. The check-in starts at 3 pm and check out ends at 12 noon on the following day.
3. If when renting the room the Guest does not specify the length of stay, it is assumed that the room was rented for one day.
4. Renting a room requires provision of necessary information, including the Guest’s personal data, to the extent necessary for the proper execution of the contract.
5. Hotel guests are subject to mandatory registration of their stay, upon arrival at the Hotel, on the basis of a valid photo ID.
6. Any wish to extend the stay/night must be made at reception by 10 am on the last day of the planned stay. If it is possible, the reception will confirm and state the terms and conditions or inform that it is not possible. Extension of check-out time until 4 pm will incur a charge of 50% of the price of the next night, and an extension until a later hour will incur a charge equal to the price of the next hotel night at the average published price for the respective room type.
7. If a guest does not request an extension and leaves their belongings in the hotel room after 12 noon, the hotel will automatically charge and debit the guest’s account with an additional fee in the amount of the published room price for the following night.
8. A Guest may not give the room for use to other persons even if the period for which the Guest has paid the fee due has not expired.
§2
1. The Hotel may refuse to accommodate Guests who, during their previous stay, have grossly violated the Hotel’s regulations, causing damage to the Hotel’s or other Guests’ property, injury to the Hotel’s staff or other persons staying at the Hotel, or otherwise disrupted the peaceful stay of the Guests or the operation of the Hotel.
2. The hotel may refuse to provide services if any point of this regulation has been violated during the stay, or if the behavior and stay of the guests disrupt the established order of service provision or work in the hotel.
3. The hotel reserves the right to refuse service if, during the guest's stay, they jeopardize the hotel's reputation, incur additional costs associated with their stay, misuse the room, and/or fail to respond to communications from the staff regarding disturbances or breaches of hotel rules. In such a situation, the guest will be asked to vacate the room without the possibility of a refund.
§3
1. The Hotel is obliged to:
  1. ensure the conditions for the Guest’s complete relaxation.
  2. respond promptly to comments and objections relating to the level of service, the operation of the hotel facilities and the cleanliness and tidiness of the hotel by taking action to promptly rectify any defects or deficiencies.
  3. ensure the security of the stay, including protection of confidentiality of information about Guests, to the fullest extent permitted by law,
  4. provide a change of bed linen and towels on request in the absence of the Guest, and in the presence of the Guest only at the express request of the Guest, unless otherwise requested by the Guest at check-in.
  5. provide room’s cleaning on request and any necessary repairs to the facilities are carried out in the Guest’s absence, and in the Guest’s presence only if he or she so requests,
2. The Hotel provides services in accordance with its category and standard. In the event of any complaints regarding the quality of services provided at the Hotel, the Guest is requested to report them as soon as possible at the reception or to the e-mail address fo@wyndhamwroclawot.com, which will enable the Hotel staff to respond promptly.
§4
1. The hotel is not responsible for money, jewellery, or other valuables left in the rooms unless these items have been deposited in the safe box located in the room or in the reception safe box. The hotel has the right to refuse to accept money, securities or valuables for safekeeping if they threaten security or are of too great a value in relation to the size or standard of the Hotel, or take up too much space.
2. The hotel is not responsible for equipment and items left in cars located in the car park. In the event of a claim, please notify the hotel reception so that the hotel can respond and clarify the situation as quickly as possible.
3. In order to secure any claims or to cover future services, the hotel charges a fee of PLN 300 or blocks funds on the card, for Walk In or other guests for whom it has no other form of payment guarantee.
§5
1. Persons who are not registered as hotel guests may stay in the hotel room from 7 am to 10 pm. After 10 pm the guest is required to register the person or persons staying in the room with him/her.
2. If additional persons are not registered in the room, the Hotel has the right to refuse to provide the hotel service due to the inability to ensure the guest’s safety.
3. The guest shall not have the right to bring any claims against the hotel (in particular as regards security or theft while in the room), if an unregistered person was staying in their room.
§6
1. The following services are provided free of charge at the Hotel at the Guest’s request:
  1. provision of information related to stay and travel,
  2. wake-up call at the appointed time,
  3. luggage storage (the Hotel staff may refuse to accept luggage for storage on dates other than the date of the Guest’s stay and items that do not have the characteristics of personal luggage).
§7
1. In order to ensure a peaceful stay for all Guests, the hotel has a curfew between 22 pm and 6 am.
2. The behaviour of Guests and persons using the services of the hotel should not disturb the peaceful stay of other Guests.
3. If peace or the operation of the Hotel is disturbed or damage is caused to the guests, employees, or other occupants of the Hotel - the Hotel has the right to refuse to provide further service and to require the guests to leave the hotel without any refund.
§8
1. It is strictly prohibited to smoke tobacco, tobacco-like products, electronic cigarettes, tobacco warmers, or other substances in the rooms.
2. If this prohibition is violated, the Hotel may charge the Guest the amount of PLN 600 for the costs of refreshing the room and/or excluding it from use for the next 24 hours, if the room is not fit for sale.
3. The hotel room is equipped with a fire and smoke sensor system. In the event of the hotel being exposed to the risk associated with the improper functioning of the sensors, such as blocking or covering with a smoke neutralizer (material, foil, etc.), the hotel will impose a penalty of 1500 PLN on the guest for causing a fire hazard.
4. For fire safety reasons, the use of open flames such as candles, electric heaters, or other similar devices is also prohibited. If, as a result of this prohibition being violated, smoke detectors located in the hotel room are activated - the Guest will be obliged to bear the costs of activating the fire procedure (including intervention by the fire brigade) and other costs accompanying this procedure.
5. Due to fire protection requirements, no electric heating appliances of any kind that are not part of the equipment of hotel rooms may be used in these rooms without consulting the reception.
§9
1. The hotel Guest shall be held fully liable for any damage to or destruction of hotel property (items of furniture and technical equipment) caused by the Guest or his/her visitors, persons under his/her care (children), or by animals. If such damage is discovered by the staff during the guest's stay or after departure, the hotel will issue a debit note on the basis of the internal LOSS PRICE LIST, after drawing up a damage report including evidence, and will charge the card on file for the above losses. The note will be issued using the provided details of the guest, to obtain payment for the damage that was done.
2. If the condition of the room after the guest's departure requires more than the standard cleaning of the room, the hotel has the right to charge for extra cleaning, priced according to the INTERNAL PRICE LIST FOR CLEANING SERVICES.
3. If there is biological soiling in the hotel room, the Guest will be charged PLN 500 to cover the costs of cleaning. In the case of special biological soiling, the cost is priced individually.
4. The guest should notify the reception of a damage as soon as it becomes apparent.
5. The hotel reserves the right to charge the Guest’s credit card for amounts corresponding to:
  1. the equivalent of the damage caused to the Property,
  2. costs of additional orders, also after the Guest’s departure.
  3. compensation for lost revenue due to the room being blocked as a result of damage caused by guests.
§10
1. Personal belongings left in the hotel room by the departing Guest are subject to the lost property storage procedure for up to 3 months. After this time, these items will be disposed of.
2. Items left behind may be sent back to the address indicated by the Guest, at the Guest's expense, only upon the Guest's prior instruction.
3. This procedure shall not apply to foodstuffs or medications.
§11
1. When leaving the room, the Guest should always check the door lock.
2. Before leaving the hotel, the Guest is requested to close the room and hand in the card at the reception.
§12
1. Pursuant to the Act of 28 July 2023 amending the Act - Family and Guardianship Code and other acts (Journal of Laws of 2023, item 1606), the Wyndham Wroclaw Old Town Hotel is obliged to apply the Standards for the Protection of Minors and the procedures contained therein.
2. The Standards for the Protection of Minors are available at the Hotel Reception and on the website www.wyndhamwroclawot.com.
3. Pursuant to the aforementioned act, the Hotel is particularly obliged to determine the identity of the minor and their relationship with the accompanying adult based on the appropriate procedure.
4. The guest confirms the identity of the minor on the registration card.
5. The guest undertakes not to leave the minor unattended at any time during the stay.
6. The guest acknowledges that the hotel staff are obliged to follow the Standards for the Protection of Minors.
§13
1. Animals are not allowed in the hotel.
2. In exceptional cases, the Hotel may agree to allow animals in the hotel, upon prior request, and subject to compliance with sections 3-6 of this clause. In such a case the fee for an animal will be PLN 120 per day.
3. Animals that may pose a threat to human life or health, especially venomous animals, are not allowed into the Hotel.
4. The Guest is obliged to take care of the animal in a way that does not endanger the safety of other Guests or the Hotel staff.
5. Any damage to Hotel property or the property of other Guests caused by animals will be assessed by the Management and the cost thereof will be charged to the Guests - the owners of the animals.
§14
1. The regulations of the SPA area and the Gym constitute an integral part of these regulations.
2. Hazardous goods - weapons and ammunition, flammable, explosive and illuminating materials - may not be stored in hotel rooms.
3. Canvassing and door-to-door selling is prohibited on hotel premises.
4. Guests are not allowed to make any changes to the hotel rooms, their furnishings, except for minor rearrangement of furniture and equipment that does not affect their functionality or the safety of other Guests.
5. The current price list of services and fees applicable to the Hotel is available at the reception.
6. Any complaints regarding the stay should be submitted to the Hotel management in writing, to the following email address: fo@wyndhamwroclawot.com
7. The competent court for disputes between the Guest and the Hotel shall be the court having jurisdiction over the registered office of the Hotel.
8. The Hotel reserves the right to refuse to accept - on behalf of the Hotel Guest - parcels, including courier deliveries, unless the Hotel has given prior consent to receive such parcels and the Hotel staff have been duly authorised.
9. The Hotel reserves the right to inspect rooms once every 24 hours, to ensure maximum comfort and safety of Guests, provided there is a reasonable suspicion of a threat to the safety of Guests.
§15

2. Personal data will be processed for purposes related to the conclusion and performance of the hotel service contract, as well as for archiving, statistical, and tax purposes.

SPA Regulations
SPA Regulations
1. These regulations define the terms and conditions for hotel guests’ use of the SPA area at Wyndham Wroclaw Old Town.
2. Using the services, treatments, and equipment in the SPA area implies familiarity with and acceptance of these regulations.
3. The SPA area is open 7 days a week, from 12:00 PM to 10:00 PM.
4. The SPA is a zone of silence and relaxation. To ensure your complete comfort, the use of personal MP3/MP4 players, cameras, mobile phones, and other similar devices is prohibited.
5. Wyndham Wroclaw Old Town is not responsible for photos, recordings, or videos taken and shared online by other guests, outsiders, or individuals not associated with Wyndham Wroclaw Old Town.
6. Silence is mandatory in the SPA area.
7. SPA staff reserves the right to ask anyone who fails to comply with these regulations and/or disturbs the comfort of other guests or staff to leave the SPA without a refund.
8. The following are prohibited in the SPA area:
  1. a) Bringing in and consuming alcohol or other intoxicants
  2. b) Smoking tobacco products or derivatives (including electronic cigarettes)
  3. c) Bringing in and consuming food, and using glass containers
  4. d) Any immoral behavior that goes beyond generally accepted social norms
9. The following individuals are not allowed to use the SPA area:
  1. Those under the influence of alcohol or other intoxicants
  2. Those with open wounds or skin inflammations
  3. Those showing symptoms of illnesses posing a risk of drowning
  4. d) Those whose behavior poses a threat to other guests or SPA staff
  5. e) Those whose hygiene does not meet generally accepted standards
10. Before entering the SPA area, guests must change their footwear and store personal belongings in the locker room. If personal footwear is not available, SPA reception offers suitable footwear for purchase.
11. All valuables should be deposited at the Hotel Reception.
12. Staff is not responsible for items left in lockers or elsewhere in the SPA area. Guests must use towels in the sauna area. Towels are available upon request from SPA staff.
13. Children under 16 years of age are not permitted in the wellness & spa area. Teenagers aged 16 to 18 may use the SPA only under adult supervision. Parents or legal guardians are fully responsible for their behavior and adherence to these regulations.
14. Guests must enter the sauna and steam room with towels covering intimate areas. Towels are provided free of charge to hotel guests using body treatments and the SPA area. Swimwear is not allowed in the sauna and steam room.
15. Extra caution must be taken in wet areas. Running and jumping into the jacuzzi are strictly prohibited throughout the SPA complex.
16. Prior reservation is required for treatments and access to sauna and jacuzzi areas.
17. A separate regulation governs the rules for treatments and massages.
18. Wyndham Wroclaw Old Town reserves the right to change SPA opening hours due to technical or other circumstances.
19. Please note that the SPA area is monitored by a video surveillance system. The purpose of monitoring is to ensure the safety of SPA guests and others on the premises. The Standards for the Protection of Minors
THE STANDARDS FOR THE PROTECTION OF MINORS at Wyndham Wroclaw Old Town (short version)

Preamble

Bearing in mind the legal obligation arising from the provisions of the Act of 13 May 2016 on Counteracting Threats of Sexual Crime and the Protection of Minors, as well as the guidelines of the United Nations on business and human rights, and recognizing the important role of business in ensuring respect for children's rights, Wyndham Wroclaw Old Town adopts the Standards for the Protection of Minors (hereinafter also referred to as “SPM” or “Standards”).

This document constitutes a set of principles and procedures applied in cases where there is a suspicion that a child staying at the Wyndham Wroclaw Old Town Hotel is being harmed, as well as for the prevention of such risks, with special consideration given to children with disabilities and those with special educational needs.

The Standards for the Protection of Minors at Wyndham Wroclaw Old Town are implemented based on the following principles:

1. Wyndham Wroclaw Old Town conducts its operational activities with respect for the rights of children as individuals particularly vulnerable to harm.

2. Wyndham Wroclaw Old Town recognizes its role in conducting socially responsible business and in promoting positive social attitudes.

3. Wyndham Wroclaw Old Town particularly emphasizes the importance of the legal and social obligation to report any suspected crime against children to law enforcement authorities and commits to training its staff in this regard.

Glossary:

For the purposes of this document, the following terms are defined as follows:

1. Child/Minor – For the purposes of these standards, a child is defined as any person under the age of 18*.
*According to Polish law, a child is any person under the age of eighteen (Article 1 of the Convention on the Rights of the Child, adopted by the United Nations General Assembly on 20 November 1989). A minor is a person who has not yet reached the age of majority, meaning someone under 18 years of age, or a female who has attained legal majority through marriage after turning 16 (Article 10 §§ 1 and 2 of the Civil Code), which may occur with the permission of the family court for valid reasons and if circumstances indicate that the marriage will serve the best interests of the newly established family (Article 10 § 1 of the Family and Guardianship Code).

2. Child’s Guardian – The child’s legal representative: a parent or legal guardian; a foster parent; or a temporary guardian (i.e., a person authorized to represent a minor citizen of Ukraine who is residing in the territory of the Republic of Poland without the care of an adult).

3. Unrelated Adult – Any person over the age of 18 who is not the child’s parent or legal guardian.**
**Parents – as defined in Article 98 of the Family and Guardianship Code.; Guardian – as defined in Article 155 of the Family and Guardianship Code; Foster Parent – as defined in Article 112¹ of the Family and Guardianship Code; Temporary Guardian – as defined in Article 25 of the Act on Assistance to Citizens of Ukraine in Connection with the Armed Conflict in the Territory of that State.

4. Child Abuse – Any behavior that may constitute a criminal act committed against a child by any person, including an employee of the entity, or any action that threatens the child’s well-being, including neglect. This includes any intentional or unintentional action/inaction by an individual, institution, or society as a whole, and any result of such action or inaction that violates the rights, freedoms, and personal dignity of children and/or disrupts their optimal development.

5. Forms of Violence Against Children:
- Physical Abuse – Violence resulting in actual or potential physical harm to a child. This harm results from actions or omissions by a parent or other person responsible for the child, or someone the child trusts or who holds authority over the child. Physical abuse may be a one-time incident or repeated acts.
- Emotional Abuse – Ongoing, non-physical, harmful interaction between a child and a caregiver, including both acts and omissions. Examples include emotional unavailability, emotional neglect, hostile or blaming interactions, rejection, developmentally inappropriate or inconsistent interactions, and failure to recognize the child’s individuality or emotional boundaries.
- Sexual Abuse – Involving a child in sexual activity that they are unable to fully understand, provide informed consent for, or that is developmentally inappropriate and/or legally invalid. Sexual abuse includes activity between a child and an adult, or between children, when there is a disparity in age, development, or a relationship of authority or dependency. Sexual abuse also includes sexual exploitation, i.e., any actual or attempted abuse of a position of vulnerability, power, or trust for sexual purposes, including but not limited to financial, social, or political gain through sexual exploitation. The risk of exploitation is especially high during humanitarian crises and may concern both children and their guardians (definition per UN Bulletin ST/SGB/2003/13).
- Neglect – Chronic or occasional failure to meet a child’s basic physical or psychological needs and/or to respect their fundamental rights, resulting in harm to health and/or developmental difficulties. Neglect occurs in the context of a relationship where the caregiver is responsible for the child’s care, upbringing, and protection.
6. Crime Against a Child – Any crime that may be committed against an adult, as well as crimes specific to children (e.g., sexual abuse under Article 200 of the Penal Code)***. Due to thenature of accommodation facilities, which allow for isolation, crimes most likely to occur on-site include those against sexualfreedom and decency, especially: rape (Art. 197 PC), sexualexploitation of incapacity or helplessness (Art. 198 PC), sexualexploitation of dependency or a critical situation (Art. 199 PC), sexual acts with a person under 15 (Art. 200 PC), grooming(using remote communication to seduce a minor – Art. 200aPC).

***The Act of 6 June 1997 – Penal Code (consolidated text: Journal of Laws of 2022, item 1138, as amended).

7. Other Forms of Child Abuse Not Constituting a Crime – All forms of violence against a child that do not meet the legal criteria for a criminal offense prosecuted by public accusation (e.g., shouting, humiliation, grabbing, name-calling, neglecting needs, etc.).

8. Employee – A person employed under an employment contract or working under a similar agreement (e.g., mandate contract, B2B, contract for specific work), including interns, trainees, and volunteers.

9. Employee Working with Children – Any person performing or assigned to perform tasks involving the education, upbringing, leisure, treatment, psychological counseling, spiritual development, sports activities, or other interests of minors, or caring for them.

10. Business Operator – The authority/entity/person managing a given facility or network of facilities, responsible for ensuring its proper legal and operational functioning.

SCOPE OF COMPETENCIES AND RESPONSIBILITIES OF PERSONS DESIGNATED TO IMPLEMENT THE STANDARDS FOR THE PROTECTION OF MINORS

1. Oversight of the implementation of the Child Protection Standards (CPS) is carried out by Presic Sp. z o.o. in consultation with the Legal Department of Mogotel SIA.

2. The hotel appoints a Coordinator responsible for the Child Protection Standards implemented at Wyndham Wroclaw Old Town (hereinafter referred to as the “Coordinator”).

3. The coordinator is responsible for familiarizing staff with the content of the CPS, all related procedures, and for monitoring their application at Wyndham Wroclaw Old Town.

4. The coordinator documents every intervention or reported incident involving harm to a child on the premises in a dedicated document called the Intervention Register.

5. In the case of a justified suspicion that a crime has been committed, the coordinator is responsible for securing evidence (including surveillance footage, official notes, photographs, videos, items left behind, and other relevant materials) and providing them to the authorities upon request, either by registered mail or in person to the prosecutor or police.

6. The coordinator is responsible for initiating procedures in situations where a child has been harmed by a hotel employee or another adult not directly employed by Wyndham Wroclaw Old Town but by a third-party entity.

7. The coordinator must report suspected crimes against children to the appropriate legal authorities (prosecutor’s office, police) no later than 24 hours from the moment the suspicion is identified.

8. The CPS at Wyndham Wroclaw Old Town are updated at least once every six months.

9. The coordinator’s contact details must be accessible to all staff, guests, and children at the facility. This information must include how to contact the coordinator. The appointed Child Protection Standards Coordinator at Wyndham Wroclaw Old Town for the period 01.03.2025 – 31.12.2025 is:

A. Prohibited Behaviors and Practices by Staff Toward Children at Wyndham Wroclaw Old Town
- It is strictly forbidden to yell at, shame, humiliate, belittle, or insult a child.
- It is prohibited to hit, poke, push, or in any way violate the physical integrity of a child, unless there is an immediate threat to the child’s health or life.
- Staff must not engage in any romantic or sexual relationships with a child, nor make inappropriate advances. This includes sexual comments, jokes, gestures, or sharing erotic or pornographic content with children in any form.
- It is not permitted to record or photograph a child for private or professional purposes without the consent of the child’s parents/guardians and the child themselves. This also applies to allowing third parties to record children. An exception is when the child appears only as an incidental part of a larger whole (e.g., a gathering, landscape, or public event), in which case parental/guardian consent is not required.
- It is prohibited to communicate with a child through private channels (personal phone, email, messaging apps, or social media profiles) or to meet with the child outside the workplace.
- Staff must never offer alcohol, tobacco products, or illegal substances to a child.
- A child must never be touched if they do not wish to be, or in a manner that could be perceived as inappropriate or indecent.
CHAPTER I. PROCEDURE FOR CHILD IDENTIFICATION DURING FRONT DESK REGISTRATION

1. One of the effective ways to prevent harm to children is to verify the identity of the child staying at the facility and establish the nature of their relationship with the accompanying adult.

2. The staff of Wyndham Wroclaw Old Town make every lawful effort to verify the identity of the child.

3. At Wyndham Wroclaw Old Town, guests are informed of the required document necessary to verify a child’s identity at the time of booking, through all hotel distribution channels (telephone, email, website, OTA services).

4. Front desk staff take all reasonable steps to verify the identity of the child and their relationship to the accompanying adult.

5. To carry out this identification, the front desk employee:

a. Requests the child’s ID or another document confirming that the adult has the legal right to care for the child. Acceptable forms of identification include: passport, ID card, ISIC (International Student Identity Card), national ID, school ID, the MObywatel app, Internet Patient Account, or a court order. If such a document is not available or is refused, the guest is asked to provide the child’s personal details (name, surname, address, PESEL number).

b. Enters the child's details and the document confirming guardianship into the system, following the standard check-in procedure. After the registration card is printed, the guest confirms the data with their signature.

c. If the accompanying adult is not the child’s parent or legal guardian, they are asked to present a document such as a notarized parental consent for the person to travel with the child, or a signed parental consent including the child’s details, home address, contact number to the parent, and the ID/PESEL number of the adult authorized to care for the child.

d. If no documents proving the relationship between the adult and the child are provided, or if the adult refuses to show them, the front desk employee has the right to ask both the adult and the child to clarify their relationship.

e. If the adult does not have any of the above-mentioned documents, they are required to complete a declaration using a template provided by the facility. The declaration must include the child’s and adult’s details, as well as a statement defining the relationship between them. If the adult is not the parent or legal guardian, they must declare that the child’s parents/legal guardians have given consent for them to supervise the child.

6. In the situation that the adult refuses to provide the child’s identification and/or clarify the relationship, the staff should explain that the procedure is in place to ensure the safety of all children staying at Wyndham Wroclaw Old Town and that, under the Act of 13 May 2016, hotel staff are required to follow child protection regulations.

7. If there are any doubts about the adult’s right to care for the minor, or if they are unwilling to provide documentation or sign the declaration, hotel staff may notify the police to ensure the child is not in danger.

CHAPTER II. PROCEDURE IN CASE OF CIRCUMSTANCES INDICATING CHILD ABUSE BY AN ADULT

1. A reasonable suspicion of child abuse arises when: a. the child discloses the abuse to a staff member, b. a staff member witnesses the abuse, c. the child shows signs of abuse (e.g., scratches, bruises) and responds inconsistently and/or chaotically when asked, or becomes visibly embarrassed, or there are other circumstances that may indicate abuse — such as finding child pornography in the room of an adult.

2. If unusual and/or suspicious situations are witnessed by employees from various hotel departments (e.g., housekeeping, room service, bar and restaurant staff, spa staff, security), they are obliged to immediately report the incident to their supervisor or, in the supervisor’s absence, to a designated decision-maker who will take appropriate action.

3. An employee who has a reasonable suspicion that a child on the premises is or has been abused must immediately report this to a supervisor or decision-maker, who will notify the police. If the child is in immediate danger, the employee must directly contact the police by calling 112 and describe the circumstances of the incident. Regardless of the above, the employee must also inform the Wyndham Wroclaw Old Town Coordinator of the incident.

4. Hotel staff or security personnel should make every effort to prevent the child and the suspected abuser from leaving the premises.

5. In situations as defined by the Code of Criminal Procedure, an employee has the right to perform a citizen’s arrest of the suspected individual. In such a case, the person detained remains under the supervision of security staff or other hotel employees until the police arrive, provided this can be done without risking personal safety.

Citizen’s arrest – Article 243 of the Code of Criminal Procedure of June 6, 1997 (consolidated text: Journal of Laws 2022, item 1375): § 1. Anyone has the right to apprehend a person caught in the act of committing a crime or in direct pursuit following the commission of a crime, if there is a fear that the person may flee or their identity cannot be determined. The term “caught in the act” includes apprehension during any punishable phase of the crime (but not an infraction), i.e., during preparation, attempt, or completion. In practice, this most often involves the attempt phase, as apprehension usually prevents completion of the act. Observing the objective aspect of the offense is sufficient for intervention. Code of Criminal Procedure. Commentary, 2nd edition, Warsaw 2020, Article 243. § 2. A person apprehended must be handed over to the police without delay.

6. Hotel staff are not authorized to verify their suspicions based on facts or evidence; this is the role of law enforcement. Citizen’s arrest does not require the crime to have been completed (e.g., catching an adult during intercourse with a child). It is sufficient to act during preparatory or attempt phases. Arresting someone during an attempt (i.e., direct action toward committing the crime) constitutes prevention of the offense. An example of an attempt would be renting a hotel room with a child.

7. In all cases, the safety of the child is the priority. The child should remain under the supervision of a staff member until the police arrive. If possible, the hotel staff should offer the child emotional support.

8. In the case of a justified suspicion that a crime involving the child’s contact with the perpetrator’s biological material (semen, saliva, skin cells) has occurred, the employee should, if possible, prevent the child from washing or eating/drinking until the police arrive. The employee should explain to the child the reason for these restrictions.

9. After the child has been handed over to the police, the employee secures CCTV footage and any other relevant evidence (e.g., documents) related to the incident, and submits it to the coordinator, who will provide copies to the prosecutor or police upon request, either by registered mail or in person.

10. Following the intervention, the employee reports the incident to the coordinator, who records it in the Incident Register.

CHAPTER III. PROCEDURE IN CASE OF IDENTIFYING OTHER FORMS OF VIOLENCE AGAINST A CHILD BY A PARENT/LEGAL GUARDIAN OR ANOTHER ADULT

1. In the event of identifying abuse of a child by a parent/legal guardian or another adult accompanying the child at the facility, every employee who witnesses such abuse is obligated to respond firmly.

2. If the child’s life or health is at risk, the person who becomes aware of the situation is required to immediately notify the police by calling the emergency number 112, providing their own details, the child’s details (if possible), the child’s location, and a description of the incident. The employee must also inform their supervisor or a decision-maker. Additionally, the person who became aware of the incident must inform the coordinator, at least via email or in writing.

3. If a staff member witnesses physical violence against a child (e.g., spanking, shaking, yelling, or other actions listed under the definition of physical abuse), they should attempt to stop the abuse and respond accordingly.

4. In the situation that a child under the age of 7 is left without supervision, the employee who becomes aware of this must inform the front desk, security, or a supervisor. The informed individuals will decide on the next steps, taking into account the circumstances and the relevant provisions of the Penal Code and the Code of Petty Offenses****. They will attempt to locate the parent/legal guardian or another adult accompanying the child and explain that the child cannot be left unattended. If it is not possible to locate the parent/legal guardian or other responsible adult, or if that person refuses and/or is unable to resume care of the child, the supervisor must notify the police. In all cases, the child’s safety must be the top priority.

CHAPTER IV. FINAL REGULATIONS

1. The Child Protection Standards shall come into force on August 15, 2024.

2. The Child Protection Standards, in areas related to statutory information for hotel guests, are available in both Polish and English in electronic form: on the Wyndham Wroclaw Old Town website at www.wyndhamwroclawot.com, on TV screens in every hotel room, as a QR Code and in printed form (Polish and English) at the Hotel Reception.

3. A simplified and child-friendly version of the Child Protection Standards, designed for children staying at Wyndham Wroclaw Old Town, is available in both Polish and English in accessible areas such as the hotel reception and lobby lounges.
